1. Agreement
These terms are an agreement between you and Owen Halpin ("we", "us") for your use of Packtrail. By creating an account or using Packtrail, you agree to these terms and to our privacy policy. If you use Packtrail for a business, you agree on behalf of that business.
2. What Packtrail is, and isn't
Packtrail lets you capture timestamped, fingerprinted photos and videos of orders as you pack them, and builds a Claim Kit (a PDF and a private share link) you can send when a buyer says an item was missing or never arrived.
Packtrail is an evidence tool only. It never pays out for losses. We don't pay for lost, missing or damaged items, refund buyers, or reimburse deductions. Whatnot alone decides claims and disputes under its own policies. Proof from Packtrail may help your response, but we can't promise any result, and we're not responsible for how Whatnot, a carrier or a buyer acts.
Packtrail is independent and isn't affiliated with or endorsed by Whatnot. Whatnot is a trademark of its owner.
3. Eligibility and your account
- You must be at least 18 and able to form a binding contract.
- Keep the email account you sign in with secure. You're responsible for activity on your Packtrail account.
- Give accurate information and keep it up to date.
- Tell us at packtrailsupport@gmail.com if you think someone else has accessed your account.
4. Connecting Whatnot
You can connect Packtrail to your Whatnot account with an access token or, when available, Whatnot's sign-in (OAuth), or upload order reports from Whatnot Seller Hub. You confirm you're allowed to share that data with us and that doing so follows Whatnot's terms and developer policies. Only connect your own Whatnot account. You can disconnect at any time. Whatnot can change or stop its API, which may limit what Packtrail can do.
5. Your content and buyer information
"Your content" means the photos, videos, notes, orders and other information you put into Packtrail. You own it. You give us permission to store, process, display and transmit it only as needed to run Packtrail for you, including showing it to people you send a Claim Kit link to.
You agree that:
- you'll capture and upload only content you have the right to use;
- you'll use buyer information only to fulfil orders and respond to claims, and follow applicable privacy laws;
- you won't alter, stage or misrepresent proof. Fingerprints and server timestamps record what was uploaded and when; they don't make altered or misleading content true;
- you're responsible for who you share Claim Kit links with. Anyone with a link can view it until it expires or you turn it off.
6. Acceptable use
Don't:
- use Packtrail for anything illegal, fraudulent or deceptive, including fake or misleading claim evidence;
- upload content that's unlawful, infringing, or that shows people who haven't agreed to be filmed where that's required;
- access another seller's data, probe or break our security, or get around plan limits;
- scrape, overload, reverse engineer or resell Packtrail, except as the law allows;
- use Packtrail in a way that breaks Whatnot's terms.
7. Plans, billing and cancellation
- Free: up to 50 proof-complete orders per calendar month (UTC), with photos and videos kept for 120 days. When you reach the limit you can finish orders you've already started, but not start new ones until the next month or until you upgrade.
- Pro: $19/month, including any applicable sales tax, billed in advance through Stripe. Unlimited proof-complete orders, with photos and videos kept for 365 days.
- Pro renews automatically every month until you cancel. You can cancel anytime from Manage billing; you keep Pro until the end of the period you've paid for, then move to Free.
- Payments aren't refundable, including for partial months, except where the law requires or we decide otherwise.
- If a payment fails, we may move you to Free after Stripe's retry period.
- We may change prices or plans with at least 30 days' notice. A price change applies from your next billing period after the notice.
8. Media retention
Photos and videos are deleted automatically when their retention period ends (see section 7 and our privacy policy), except media on an order with an open or submitted claim. Download anything you need to keep longer. If you move from Pro to Free, existing media keeps its current deletion date. We're not responsible for media deleted under these rules, or for keeping your only copy.
9. Our service and feedback
Packtrail's software, design and brand belong to us. We give you a personal, non-transferable right to use Packtrail under these terms. If you send us ideas or feedback, we may use them without owing you anything.
10. Third-party services
Packtrail relies on services we don't control, including Whatnot, Stripe, Supabase, Vercel and shipping carriers. Their terms apply to your use of them, and we're not responsible for their actions, outages or changes.
11. Changes and availability
We may add, change or remove features. We aim to keep Packtrail available but can't promise it will always be available or error-free. If we stop offering Packtrail, we'll give you at least 30 days' notice where we reasonably can, so you can download your content.
12. Ending your account
You can stop using Packtrail and ask us to close your account at any time. We may suspend or close accounts that break these terms, harm other users or buyers, or create legal risk, and we'll tell you why unless the law or safety prevents it. Sections 5 (your responsibilities), 9, and 13 to 16 continue after your account ends.
13. Disclaimer
Packtrail is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that Packtrail will be uninterrupted, error-free or produce any particular result in a claim or dispute.
14. Limitation of liability
To the extent the law allows, we won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, inventory, claim deductions, account suspensions or data, even if we were told they were possible. Our total liability for all claims relating to Packtrail is limited to the greater of the amount you paid us in the 12 months before the claim, or $50.
Some places don't allow these limits, so some of them may not apply to you.
15. Indemnity
If someone brings a claim against us because of your content, your use of buyer information, or your breach of these terms or Whatnot's terms, you'll cover our reasonable costs and liabilities from that claim, to the extent the law allows.
16. Governing law and disputes
These terms are governed by the laws of Ohio, USA, without regard to conflict-of-law rules. Before filing a claim, please contact us at packtrailsupport@gmail.com so we can try to resolve it informally within 30 days. Any dispute that isn't resolved will be heard in the state or federal courts located in Ohio, and both of us agree to those courts' jurisdiction. Either of us may bring a qualifying claim in small claims court instead.
17. General
We may update these terms. For a material change, we'll update the date at the top and give you notice by email or in the app at least 14 days before it takes effect; continuing to use Packtrail after that means you accept the change. These terms and the privacy policy are the whole agreement between us about Packtrail. If part of these terms can't be enforced, the rest still applies. Not enforcing a term isn't a waiver. You can't transfer these terms without our consent; we may transfer them as part of a merger or sale of Packtrail.
